Terms of Use

1. Agreement
By downloading or using the Snap & Swipe iOS app ("the app"), you agree to these Terms of Use. If you do not agree, please do not use the app.

3. License
We grant you a personal, non-transferable, non-exclusive license to install and use the app on Apple devices that you own or control, according to Apple's Licensed Application End User License Agreement (Standard EULA).
4. Free and paid features
Snap & Swipe is free to download. Free users can review up to 50 photos. To continue using the app without limits and to unlock features like similarity-based duplicate detection, a Pro subscription or one-time purchase is required.
5. Subscriptions and one-time purchase
The following paid options are available:
- Weekly — €0.99 per week, auto-renewing
- Monthly — €2.99 per month, auto-renewing
- Yearly — €9.99 per year, auto-renewing
- One-time purchase — €14.99, no renewals, permanent access
Subscriptions automatically renew at the end of each period at the then-current price unless cancelled at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your iOS device's Settings → Apple ID → Subscriptions.
Payments: All purchases are processed by Apple via your Apple ID. We do not have access to your payment information.
Refunds: Refund requests must be made through Apple at reportaproblem.apple.com. We cannot issue refunds directly.
"One-time purchase": The one-time purchase grants permanent access to all current Pro features of the app version it was purchased for. It is automatically restored on any Apple device signed in to the same Apple ID, via "Restore Purchases" in the app's Settings. Should the app be discontinued or fundamentally restructured into a separate new app, the one-time purchase may not extend to such future product. We will give reasonable notice in such cases.
6. Your responsibilities
You are responsible for:
- Reviewing photos carefully before confirming deletion. Once you confirm deletion in the iOS dialog, photos go to "Recently Deleted" for 30 days, after which they are permanently removed by iOS.
- Backing up your photos. We recommend keeping a backup (e.g., iCloud Photos, computer, external drive) before any major cleanup session.
- Compliance with Apple's terms and your local laws when using the app.
7. Disclaimer of warranty
The app is provided "as is", without warranty of any kind. We do not guarantee that the app will be uninterrupted, error-free, or that any defects will be corrected. To the maximum extent permitted by law, we disclaim all warranties, express or implied.
8. Limitation of liability
To the maximum extent permitted by law, Tobias Paltz / Topasells shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including loss of data, lost photos, or business interruption. This does not limit liability for damages resulting from intentional misconduct or gross negligence, nor does it limit any liability that cannot be excluded under applicable law.
You agree to carefully review photos before confirming deletion. We are not liable for photos you delete using the app.
9. Privacy
Your privacy is governed by our Privacy Policy. Snap & Swipe runs entirely on your device and does not collect or transmit personal data.
10. Changes
We may update these Terms from time to time. The current version is always available at this URL. Material changes will be communicated through the app or noted at the top of this page.
11. Apple-specific terms
You acknowledge that these Terms are between you and Tobias Paltz, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. In the event the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price; beyond that, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.
12. Governing law
These Terms are governed by the laws of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods does not apply. Mandatory consumer protection rights of the country where you reside remain unaffected.
13. Online dispute resolution
The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
